Since the controversy over cartoons of the Prophet Muhammad erupted, Europe's leaders have shown remarkable--and uncharacteristic--courage under fire. Refusing to apologize for the alleged slight to religious Muslims, a chorus of Continental voices has instead risen to the cartoons' defense, citing freedom of expression as the very essence of liberty, democracy and the European Way.

Unfortunately, free speech is about the weakest card in Europe's hand these days. An Austrian court's conviction and sentencing of the British historian David Irving to three years imprisonment for Holocaust denial is merely the most recent footnote to European hypocrisy on freedom of expression over the past decade.

The European Convention on Human Rights, which legally binds all EU states and supersedes domestic law, explicitly guarantees "the right to freedom of expression" including "the freedom to hold opinions and to receive and impart information and ideas without interference by public authority."

This provision is in keeping not only with the U.S. Bill of Rights, but with the central instruments of international human rights law to which Europe and America claim adherence. Yet Europe's interpretation of free expression has diverged markedly from America's broad deference to First Amendment freedoms of speech, assembly and religion.

American courts have upheld the publication of false, even racist materials, the right of neo-Nazis to rally in Jewish neighborhoods, and the objections of some citizens to the Pledge of Allegiance and to school dress codes on religious grounds.

European governments, on the other hand, have consistently trampled analogous rights, outlawing publication of hate speech, trade in Nazi paraphernalia, and the wearing of distinctive religious clothing, to name but a few recent examples.

According to the Austrian court that convicted him on Monday, David Irving's offense was to have "denied, grossly played down, approved, or tried to excuse" the Holocaust in print or other media, in violation of a 1992 statute. Although he has not been tried at home in Britain, Irving was convicted and fined in Germany in 1995 for "inciting race hatred."

At best, Irving is a monumentally terrible historian, who, only after publishing dozens of books on World War II, read the notes of the Holocaust mastermind Adolf Eichmann and came around to admitting that the Nazi genocide might actually have occurred. At worst, he is an artless but unrepentant bigot, on the model of America's David Duke or Austria's own Jörg Haider, but without any independent political power.

Why, then, is Irving's Holocaust denial, like other minority and extremist views in European society, of such great concern to lawmakers? If European governments want to guard against the repetition of genocide, they should actively educate their citizens in tolerance and respect for different cultures and beliefs, not gag those who express conflicting ideas.

Europe's suppression of free speech is guaranteed to spawn and incubate precisely the kind of bigotry and sectarian violence it is intended to prevent. Hounded for the unthinkable crime of publishing false history, David Irving appears almost heroic as he stands up to censorship, fines and imprisonment, making him a kind of martyr for neo-fascist groups.

Likewise, suppression of young Muslims' rights to dress or worship as their religion requires lends government sanction to already widespread anti- Muslim attitudes. This official xenophobia in turn breeds simmering resentment that has already exploded into mass violence and been manipulated by radical Islamists to recruit willing terrorist agents from within European society.

While European leaders should be praised for their belated conversion to the cause of free speech, outraged Muslims around the world are right to allege a double standard. Until Europe consistently respects its own guarantees of free expression, and actively promotes tolerance instead of clumsily stifling dissent, its brave rhetoric will ring disappointingly false.

Lyman and Morrison will discuss the Council on Foreign Relations-sponsored Independent Task Force Report on the US and Africa. The Report argues that Africa is becoming steadily more central to the United States and to the rest of the world in ways that transcend humanitarian interests. Africa now plays an increasingly significant role in supplying energy, preventing the spread of terrorism, and halting the devastation of HIV/AIDS. Africa's growing importance is reflected in the intensifying competition with China and other countries for both access to African resources and influence in this region. A more comprehensive U.S. policy toward Africa is needed, the report states, and it lays out recommendations for policymakers to craft that policy. The report is available at www.cfr.org.

Princeton N. Lyman is the Ralph Bunche Senior Fellow and Director for Africa Policy Studies at the Council on Foreign Relations. He is also an Adjunct Professor at Georgetown University. Ambassador Lyman served for over three decades at the U.S. Department of State and the U.S. Agency for International Development (USAID), completing his government service as Assistant Secretary of State for International Organization Affairs. He was previously Ambassador to South Africa, Ambassador to Nigeria, Director of Refugee Programs and Director of the USAID Mission to Ethiopia.

From 1999 to 2000, he was Senior Fellow at the United States Institute of Peace. Ambassador Lyman held the position of Executive Director of the Global Interdependence Initiative of the Aspen Institute (1999 to 2003) and has received the President's Distinguished Service Award and the Department of State Distinguished Honor Award. Ambassador Lyman has published on foreign policy, African affairs, economic development, HIV/AIDS, UN reform, and peacekeeping. He coauthored the Council on Foreign Relations Special Report entitled Giving Meaning to "Never Again": Seeking an Effective Response to the Crisis in Darfur and Beyond. His book, Partner to History: The U.S. Role in South Africa's Transition to Democracy, was published in 2002. He earned his B.A. from the University of California at Berkeley and his Ph.D. in Political Science from Harvard University. He serves as the Co-Director of the Council on Foreign Relations-sponsored Independent Task Force on Africa.

J. Stephen Morrison is Director of the Africa Program and the Task Force on HIV/AIDS at the Center for Strategic and International Studies (CSIS). He joined CSIS in January 2000 and in late 2001, launched the CSIS Task Force on HIV/AIDS. The task force is a multiyear project co-chaired by Senators Bill Frist (R-TN) and John Kerry (D-MA) and funded by the Gates Foundation and the Catherine Marron Foundation. Dr. Morrison co-chaired the reassessment of the U.S. approach to Sudan that laid the basis for the Bush administration push for a negotiated peace settlement, and in the summer of 2002 he organized an energy expert mission to the Sudan peace negotiations in Kenya.

From 1996 through early 2000, Dr. Morrison served on the Secretary of State's Policy Planning Staff, where he was responsible for African affairs and global foreign assistance issues. In that position, he led the State Department's initiative on illicit diamonds and chaired an interagency review of the U.S. government's crisis humanitarian programs. From 1993 to 1995, Dr. Morrison conceptualized and launched USAID's Office of Transition Initiatives; he served as the office's first Deputy Director and created post-conflict programs in Angola and Bosnia. From 1992 until mid-1993, Dr. Morrison was the Democracy and Governance Adviser to the U.S. embassies and USAID missions in Ethiopia and Eritrea. He serves as the Co-Director of the Council on Foreign Relations-sponsored Independent Task Force on Africa.

Martha Crenshaw is the Colin and Nancy Campbell Professor of Global Issues and Democratic Thought and Professor of Government at Wesleyan University, in Middletown, Conn., where she has taught since 1974. She has written extensively on the issue of political terrorism; her first article, "The Concept of Revolutionary Terrorism," was published in the Journal of Conflict Resolution in 1972. Her recent work includes the chapter on "Coercive Diplomacy and the Response to Terrorism," in The United States and Coercive Diplomacy (United States Institute of Peace Press), "Terrorism, Strategies, and Grand Strategies", in Attacking Terrorism (Georgetown University Press), and "Counterterrorism in Retrospect" in the July-August 2005 issue of Foreign Affairs. She serves on the Executive Board of Women in International Security and chairs the American Political Science Association Task Force on Political Violence and Terrorism.

She has served on the Council of the APSA and is a former president and councilor of the International Society of Political Psychology (ISPP). In 2004 ISPP awarded her its Nevitt Sanford Award for Distinguished Scientific Contribution and in 2005 the Jeanne Knutson Award for service to the society. She serves on the editorial boards of the journals International Security, Orbis, Political Psychology, Security Studies, and Terrorism and Political Violence. She coordinated the working group on political explanations of terrorism for the 2005 Club de Madrid International Summit on Democracy, Terrorism and Security. For the next three years she will be a lead investigator with the new National Center for the Study of Terrorism and the Response to Terrorism at the University of Maryland, funded by the Department of Homeland Security. She is also the recipient of a John Simon Guggenheim Memorial Foundation Fellowship in 2005-2006. She serves on the Committee on Law and Justice and the Committee on Determining Basic Research Needs to Interrupt the Improvised Explosive Device Delivery Chain of the National Research Council of the National Academies of Science. Ellen Johnson Sirleaf's inauguration provides the U.S. administration a chance to show it is serious about supporting nascent democracies, creating stability in a volatile region, and providing economic opportunities for Africa's poorest countries. CISAC's Jeremy M. Weinstein and colleague Steve Radelet tell how, in this Boston Globe op-ed.

Ellen Johnson Sirleaf's inauguration as the president of Liberia marks a watershed in the country's tumultuous history.

Twenty-five years of misrule and civil war under Samuel Doe, Charles Taylor, and successive interim governments have left the country in ruins. Nearly 300,000 Liberians lost their lives, average income is one-eighth what it was in 1980, and large majorities of the population subsist in dire poverty.

Since United Nations and US troops ousted Taylor in 2003, a fragile peace has taken hold, supported by 15,000 UN peacekeepers. With free and peaceful elections under their belts, Liberians are feeling new optimism and hope. Markets here are bustling, stores are freshly painted and open for business, and newspapers and radios feature lively debate.

The new government is a clear break from a past characterized by rule by force, extensive corruption, and a culture of impunity. Sirleaf, the first African woman elected head of state, has been an outspoken champion of accountability, transparency, and good governance for decades, a stance that landed her in jail twice and was a hallmark of her opposition to past governments and campaign for the presidency.

Already change is underway. She has instituted a code of conduct and full financial disclosure for senior officials, and endorsed a program that will install internationally recruited financial controllers in several state enterprises and create a strong anticorruption commission. Her government plans to publish financial accounts on the Web, make it easier for whistleblowers to report infractions, and rewrite Liberia's outdated constitution to firmly establish participatory democracy, decentralize power, and install robust checks on the executive.

Recovery from deep conflict in Africa is not easy, but we know it is possible. Mozambique was destroyed by civil war in the 1980s, but its democratically elected government led the way to peace, stability, and a doubling of income in a dozen years. Sierra Leone suffered a blood bath in the 1990s, but the 1999 peace agreement and 2001 elections brought stability and economic growth of 7 percent a year. Rwanda's genocide was followed by a recovery that few could have imagined.

But Sirleaf faces a daunting task. Liberia's recovery will depend mainly on Liberians themselves, but it will require strong international support, just as in Mozambique, Sierra Leone, and Rwanda.

West Africa's civil wars have spawned widespread smuggling of diamonds, transshipment of drugs, and easy money laundering opportunities for global terrorist groups. Liberia's historic moment provides the U.S. administration a chance to show it is serious about supporting nascent democracies, creating stability in a volatile region, and providing economic opportunities for Africa's poorest countries.

First, the United States must continue its crucial role in the demobilization of combatants and commit to long-term rebuilding of Liberia's police and army. The new government must be able to maintain and enhance security to begin to recover.

Second, the administration should support rapid and comprehensive forgiveness of Liberia's debts, which were mainly undertaken and wasted by the rapacious Doe government. It makes no more sense to stick today's Liberians with the bill, including 20 years of accumulated interest, than to force today's Iraqis to pay Saddam Hussein's bills.

Third, and perhaps most urgent, Congress should approve supplemental funding of $50 million to $100 million to support the new government. Unfortunately, Congress recently cut the administration's initial request for Liberia, a short-sighted step that sent the wrong signal to a struggling democracy and old ally at a crucial turning point. These funds would build critical infrastructure, put kids back into schools, and continue vital training for security forces. It would give Liberians their best chance of securing peace and basic freedoms.

Few of us will ever be asked to torture. But, indirectly, all of us have to make a choice: to support, as citizens, those politicians who back torture, or those who seek its prohibition. This decision seems a purely moral question. But what would be the long-term consequences to society if we were to make this radical break with the past? CISAC science fellow Jonathan Farley provides some mathematical insights.

You burst into the room. Sitting on a chair, blindfolded, his hands tied behind his back, is your prisoner. The room is dark, except for a lonely naked bulb hanging from the ceiling. He is sweating. He is afraid.

"Tell me where it is!" you scream. "Now!" You know there is little time left. Somewhere in your city, a time bomb is ticking. Whether it spits serin into the air, uranium into the water or atomic fire into the heavens, you do not know.

He does. But he is not talking. Involuntarily, you raise your hand as if to strike. What you are about to do violates the law and your conscience. And yet...

In peacetime, torture ranks next to murder as a primal sin. But during war, the debate begins over whether this evil can ever be justified to combat the seemingly greater evil of the enemy. Harvard law Professor Alan Dershowitz has said torture should be legalized.

In early October, the U.S. Senate voted 90-9 to ban it. Although Secretary of State Condoleezza Rice and President Bush have both recently asserted that "We do not torture," five U.S. Army Rangers were charged in November for punching and kicking detainees in Iraq, secret U.S. prisons have caused anxiety in Europe, and Vice President Dick Cheney has battled to win the CIA an exemption from the torture ban. As late as December, the U.S. House of Representatives stood poised to defeat the White House.

Few of us will ever be asked to torture. But, indirectly, all of us have to make a choice: to support, as citizens, those politicians who back torture, or those who seek its prohibition.

The decision of an individual to support, or reject, torture seems at first to be a purely moral question. But what would be the long-term consequences to society if we were to make this radical break with the past?

One cannot do experiments with societies, or predict the future, but, it turns out, one can attempt to address this issue using the cold, hard tools of mathematics and logic. This story begins in 1963.

The United States and the Soviet Union are on the perpetual brink of war, balanced like two sides of an equation. On the American side are "game theorists" like Thomas Schelling, recently awarded the Nobel Prize for his work on the strategy of conflict. On the Soviet side, there is the solitary mathematical psychologist Vladimir Lefebvre.

Just as mathematics could be used to describe logical reasoning, Lefebvre saw that mathematics could be used to describe ethical reasoning. If something was good -- for example, "church," "democracy," "prosperity," "kindness" -- it had value "1."

If something was evil -- "earthquake," "famine," "military defeat," "murder" -- it had value "0." But rarely were ethical situations so simple. For instance, "killing" is bad (0) but protecting one's country is good (1) -- so is war 1 or 0?

Lefebvre saw that, at the crudest level, there were essentially two types of ethical systems. Those that held that employing evil means to attain just ends was good, and those that saw that employing evil means to attain good ends was wrong.

There were also, crudely put, two types of relations between individuals: those entailing compromise (or cooperation) and those entailing confrontation.

Of course, evil people rarely see themselves as evil. So Lefebvre had to incorporate in his model of human nature the capacity of human beings to judge -- correctly or incorrectly -- the goodness or evil of their own acts, and to reflect upon their own judgments, and others'. "Reflexive Theory" was born.

It quickly became a paradigm within the Soviet defense establishment, with the publication of books such as "Mathematics and Armed Conflict." Nothing like it was known in the West.

With very simple assumptions -- for instance, that an individual who correctly sees his actions to be good when they are good, and evil if they are evil, is more highly regarded by society than an individual who incorrectly sees himself -- Lefebvre showed that in a society that accepted the compromise of good with evil, individuals would more often seek the path of confrontation with each other.

Lefebvre's insights were called upon by the State Department during negotiations with Mikhail Gorbachev in Reykjavik, Iceland. (And perhaps Lefebvre's model could be re-enlisted to help U.S. officials understand and negotiate with Arab and Muslim heads of state, who must also negotiate with their people.)

In support of Lefebvre's revolutionary new theory, a survey of Soviet émigrés and Americans was conducted in the 1970s. They were asked questions like, "Should a doctor conceal from a patient that he has cancer in order to diminish his suffering?" Overwhelmingly, the Americans would say no, and overwhelmingly, the Soviets yes. The Soviets accepted the compromise of good with evil; the Americans rejected it.

What does this mean? If Americans begin to accept the use of torture, American society might turn into a society of individuals in conflict.

Not uniformly, thanks to something called free will, but generally, with harmful consequences for society: Imagine two roads, with a stream of cars moving along each one. Each driver wants to reach his destination as quickly as possible; on occasion, drivers will impede each other.

On the first road, drivers rise in their own, and in other drivers', estimation if they yield. Drivers on the second road lose face when they yield. It is clear that traffic will move faster on the first road than on the second.

It can be argued that repressive states like Saudi Arabia, which bred most of the Sept. 11 hijackers, are on the second road. If the United States moved to accept torture, it could veer toward the second road, too -- the road of the Soviet Union.

And we know where that road ends. The Soviet Union no longer exists.

It can be argued that repressive states like Saudi Arabia, which bred most of the Sept. 11 hijackers, are on the second road. If the United States moved to accept torture, it could veer toward the second road, too -- the road of the Soviet Union.

And we know where that road ends. The Soviet Union no longer exists.

This article adopts a two-tiered approach: it provides a detailed, historical account of anti-terrorist finance initiatives in the United Kingdom and United States--two states driving global norms in this area. It then proceeds to a critique of these laws. The analysis assumes--and accepts--the goals of the two states in adopting these provisions. It questions how well the measures achieve their aim. Specifically, it highlights how the transfer of money laundering tools undermines the effectiveness of the states' counterterrorist efforts--flooding the systems with suspicious activity reports, driving money out of the regulated sector, and using inappropriate metrics to gauge success. This article recognizes that both states consider the fight against terrorism to be partly military but also a matter of bringing certain democratic principles to bear. Critics have been quick to condemn some of the measures for their encroachments into civil liberties. My goal is not to measure the success of the laws according to any particular ideology but rather, accepting the governments' democracy-promoting goals, and the role these play in generating domestic and international support, to clarify which components do not appear to serve the states' aims.

We investigate the impact on effective terrorism response of the viability degradation of biological weapons agents in the environment. We briefly review the scientific understanding and modeling of agent environmental viability degradation. In general, agent susceptibility to viability loss is greatest for vegetative bacteria, intermediate for viruses, and least for bacterial spores. Survival is greatest in soil and progressively decreases in the following environments: textiles, water, hard surfaces, and air. There is little detailed understanding of loss mechanisms. We analyze the time behavior and sensitivity of four mathematical models that are used to represent environmental viability degradation (the exponential, probability, and first- and second-order catastrophic decay models). The models behave similarly at short times (<30 min for our example case) but diverge to significantly different values at intermediate to long times. Hence, for a release event in which the majority of atmospheric exposure or deposition occurs over very short times, the current response models likely provide a good representation of the hazard. For longer time phenomena, including decontamina tion, the current model capabilities are likely insufficient. Finally, we implement each model in a simple numerical integration of anthrax dispersion, viability degradation, and dose response. Decay models spanning the current knowledge of airborne degradation result in vastly different predicted hazard areas. This confounds attempts to determine necessary medical and decontamination measures. Hence, the current level of understanding and representation of environmental viability degradation in response models is inadequate to inform appropriate emergency response measures.

On June 16, 2002, Dennis Pluchinsky, a senior intelligence analyst at the U.S. Department of State, wrote an article in the Washington Post calling for censorship. The article began, "I accuse the media in the United States of treason." Pluchinsky, who worked counterterrorism in the government for twenty-five years, pointed to post-9/11 articles that revealed not scientific advancements, but American vulnerabilities in regard to the food supply, electricity, chemical production, transportation, and border security. He suggested that research conducted by the media could not have been funded by one, single terrorist organization: "Our news media, and certain think tankers and academicians, have done and continue to do the target vulnerability research for them."

Pluchinsky has a point. Terrorist organizations can and do use the media--and the protections afforded speech in the United States and the United Kingdom--to obtain and disseminate critical information.

The crucial point is this: Both liberal, democratic states, and nonstate terrorist organizations need free speech. Under what circumstances are the interests of the state secured and the opportunism of terrorist organizations avoided? Here, the experiences of the United States and United Kingdom prove instructive. On both sides of the Atlantic, where the state acts as sovereign, efforts to restrict persuasive political speech have relaxed over time to allow for more criticism. In the United States, Brandenburg v. Ohio cemented this shift. In the United Kingdom, change came gradually. The practical elimination of treason and seditious libel, and incorporation of the European Convention of Human Rights (ECHR) into domestic law through the 1998 Human Rights Act (HRA), marked the transition. If free speech remains central to our understanding of liberal democracy, it would nevertheless be naïve to rely on these alterations to protect expression in the contemporary counterterrorist environment--regardless of how remarkable they might be in the context of what went before.

Underlying my argument in this paper is a deeper concern that centers on the shifting nature of technology. What the average person could have done in 1776, or for that matter, 1976, to hurt either state pales in comparison to what a person with basic knowledge of microbiology, $1000, and a lab can do today. But neither American nor British law appears to have come to terms with what weapons of mass destruction, in terrorist hands, means for free speech.

This article won the 2004-2005 Steven M. Block Civil Liberties award for the best piece of writing in civil liberties at Stanford Law School. It also won second place in the national competition for the 2005 Judge John R. Brown Award for Excellence in Legal Writing, which recognizes the best legal writing by U.S. law students.
